Terms of Service

1. Introduction

Welcome to Evelio. These Terms of Service ("Terms") govern your access to and use of Evelio's marketing website (evelio.app), the Evelio creator platform (hub.evelio.app), and the Evelio mobile application (collectively, the "Service"), operated by Evelio Oy, a company incorporated in Finland. By accessing or using the Service you agree to be bound by these Terms.

2. Acceptance of Terms

By creating an account or using any part of the Service you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service. We reserve the right to update these Terms at any time; continued use after changes are posted constitutes acceptance of the revised Terms.

3. Description of Service

Evelio is an events discovery platform. The Service consists of:

• Marketing website (evelio.app) — public-facing information and newsletter subscription.
• Creator platform (hub.evelio.app) — a web application where event organisers and creators can publish events and manage locations.
• Mobile app — an iOS and Android application for discovering nearby events.

The mobile app is distributed through the Apple App Store and Google Play Store. Your use of the app is also subject to the applicable platform provider's terms of service. Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility for the Service.

4. User Accounts & Eligibility

You must be at least 13 years old to use the Service. By registering you confirm that you meet this age requirement. Accounts can be created via Google OAuth, Apple OAuth, or email one-time password (OTP). You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

To delete your account, contact us at joel@evelio.app or use the account deletion option within the app. We will process deletion within 30 days. Deletion is permanent and cannot be undone.

5. User-Generated Content

Creators using hub.evelio.app may submit events, descriptions, images, and location information ("Content"). By submitting Content you grant Evelio Oy a non-exclusive, worldwide, royalty-free licence to display and distribute that Content within the Service for the purpose of operating the platform. You retain ownership of your Content. You are solely responsible for ensuring your Content complies with applicable laws and does not infringe third-party rights.

Evelio does not guarantee the accuracy, completeness, or reliability of any user-submitted event information (including dates, times, locations, or ticket availability). Users rely on event information at their own risk.

6. Subscriptions & Payments

Certain features of the Service are available via paid subscription. Subscription billing is processed through Polar.sh. By subscribing you agree to Polar.sh's payment terms. All fees are charged in the currency displayed at checkout. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled in accordance with Polar.sh's refund policy and applicable Finnish consumer protection law.

7. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Post false, misleading, or fraudulent event information.
• Scrape, crawl, or otherwise extract data from the Service without prior written consent.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Transmit spam, malware, or other harmful content.
• Impersonate another person or entity.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding user-submitted Content) are and will remain the exclusive property of Evelio Oy. The Evelio name, logo, and associated marks are trademarks of Evelio Oy. Nothing in these Terms grants you a right to use our trademarks without our prior written consent.

9. Indemnification

You agree to indemnify, defend, and hold harmless Evelio Oy and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your Content, or your violation of these Terms or any applicable law.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by Finnish law, Evelio Oy will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) €50.

11. Termination & Suspension

We reserve the right to suspend or permanently terminate your access to the Service, at our sole discretion and without prior notice, if we reasonably believe that you have:

• violated these Terms or any applicable law or regulation;
• posted false, misleading, or fraudulent content;
• engaged in abusive, harmful, or disruptive behaviour toward other users or the platform;
• attempted to circumvent security measures or misuse the Service in any way.

Upon termination, your right to access the Service ceases immediately. Any Content you have published (events, images, locations) may be removed at our discretion within 30 days of termination. If you believe your account was suspended or terminated in error, contact us at joel@evelio.app.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Finland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Helsinki, Finland, without prejudice to any mandatory consumer protection rights you may have under EU law.

13. Changes to Terms

We may modify these Terms at any time. When we make material changes we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evelio Oy regarding the Service and supersede any prior agreements.
